Back in June, Home Depot said it intended to defend its position as power tool market share leader. Now the giant chain finds itself a defendant in a lawsuit filed by Orchard Supply Hardware.

In a 43-page complaint, San Jose, Calif.-based Orchard said it's being iced by power tool makers Milwaukee and Makita at the urging of the world's largest home improvement retailer. "Orchard Supply vs. Home Depot, Milwaukee Electric Tool and Makita USA" was filed in December in U.S. District Court in San Francisco. OSH claims the defendants are running an unlawful group boycott.

In a pilot now being conducted in San Francisco, the U.S. Postal Service is experimenting with a same-day delivery service of e-commerce packages. The project, called “Metro Post,” will begin on or about Dec. 12 in San Francisco and run for the next 12 months, according to John Friess, a public relations representative for the postal service.

If all goes well, the Post Office has selected more than two dozen cities that are large, densely populated metro areas that could support the Metro Post business model, according to Friess.

This position, which Kent Jones, an attorney with Nixon Peabody in San Francisco, characterized in an interview with SHRM Online as “a terrible stretch,” applies to all employers -- unionized or not.

The NLRB floated this theory in a pair of cases earlier this year at the Phoenix regional office.

Saying it needs to address concerns raised by members, core LEED users and stakeholders, the U.S. Green Building Council (USGBC) announced June 4 that it will delay balloting on LEED 2012 until June 1, 2013. (One caveat: The possibility also exists that the balloting could take place earlier in 2013 if USGBC members and the market indicate readiness for ballot, the announcement said.) Because of this date change, LEED 2012 is being renamed LEED v4.

In addition to the ballot date change, other actions include:

According to San Francisco's ABC7 News, Tuggy's Hardware, which opened in 1898, continues to advise customers on the art of home improvement in the Noe Valley neighborhood of San Francisco.

The article quotes Denny Giovanolli, who began working at Tuggy's when he was 12. One of the keys to the store's longevity, especially in an age of national chains, is its knowledge of local homes and the parts needed to keep them running.

Some of the best leaders in retail have been hammering at customer service initiatives throughout the home channel for years on end. So how are they doing? According to research from San Francisco-based MarketTools Inc., pretty good, but not great.

Of 1,000 consumers asked to think back to their last time they shopped at a home improvement store and describe service on a scale of 1 to 9, the average mark was 6.5. The study, conducted in July using a nationally representative sample of consumers, also found 75.3% believe service has neither improved nor declined.
